1. Scope

1.1 These general terms and conditions govern all contracts concluded between Colour and Life SARL (hereinafter "we", "us" or "the Seller") and you as the customer through the online shop at www.colourand.life.

1.2 A customer within the meaning of these terms is any natural or legal person who places an order. A consumer is any natural person who concludes the contract for purposes that are predominantly outside their trade, business, craft or profession.

1.3 The version applicable is the one in force at the time of the order. You may view, save and print these terms on the website at any time. They are made available to you during the order process, before you submit your order, and accepted by you through an active confirmation.

 

2. Conclusion of the contract

2.1 The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.

2.2 You place a binding order by completing the checkout process and confirming the order by clicking the button marked "order with obligation to pay" (or an equivalent unambiguous wording). By placing this order, you make a binding offer to conclude a contract of sale.

2.3 After receipt of your order, you will receive an automatic acknowledgement of receipt by email. This acknowledgement does not constitute acceptance of your offer. The contract is concluded only when we accept your order by a separate order confirmation or when we dispatch the goods.

2.4 The contract text is stored by us. We send you the contract text and these terms on a durable medium together with the order confirmation.

2.5 The contract may be concluded in German, French or English, depending on the language version of the website you have selected.

 

3. Prices and payment

3.1 All prices stated are final prices in euros and include the value added tax (VAT) applicable by law. Colour and Life SARL is registered for VAT (VAT number LU37446340).

3.2 Shipping costs are not included in the stated prices. They are shown separately and displayed during the order process before you submit your order. The shipping costs set out in section 4 apply.

3.3 The following means of payment are available: credit and debit card via the payment service provider Stripe, PayPal, Apple Pay and Google Pay. The means of payment actually available in a given case are shown to you during the order process.

3.4 The purchase price is due upon completion of the order. The charge is made in accordance with the terms of the payment service provider you have selected. The terms of use of the relevant payment service provider apply in addition.

 

4. Shipping and delivery

4.1 Shipping is provided worldwide via Post Luxembourg and appointed carriers.

4.2 Shipping costs depend on the delivery destination and are as follows:

  • Luxembourg: 10 to 12 euros

  • Rest of the European Union: 19 to 23 euros

  • Rest of the world: 42 to 58 euros

The exact shipping costs for your order are shown to you during the order process before you submit your order.

4.3 For deliveries to countries outside the European Union, additional customs duties, taxes, import charges or other fees may apply. These are not included in the purchase price or in the shipping costs and are borne by you as the customer.

4.4 Unless expressly stated to be binding, information on delivery times constitutes non-binding guidance. Your statutory rights in the event of late delivery remain unaffected.

 

5. Consumer right of withdrawal

5.1 Consumers have a statutory right of withdrawal. You may withdraw from the contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you, or a third party named by you who is not the carrier, take physical possession of the goods.

5.2 To exercise your right of withdrawal, you must inform us (Colour and Life SARL, 1 rue des Romains, L-8284 Kehlen, info@colourand.life, +352 621 141 873) of your decision to withdraw from the contract by an unequivocal statement. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

5.3 In the event of a valid withdrawal, we will reimburse all payments received from you, including the costs of delivery (with the exception of the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and no later than 14 days from the day on which we are informed of your decision to withdraw. We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is the earlier. You bear the direct cost of returning the goods.

5.4 Exclusion of the right of withdrawal. The right of withdrawal does not apply to contracts for the supply of goods that are made to the consumer's specifications or are clearly personalised. This applies in particular to the personalised Soul Portraits, which are made specifically for you on the basis of the individual information you provide (in particular the child's name and age). For these products, your right of withdrawal lapses once their production has begun. Legal basis: Article L.222-9 (7) of the Luxembourg Code de la consommation.

 

6. Statutory guarantee

6.1 The statutory provisions on the conformity of goods apply. As a consumer, in the event of a lack of conformity you have a statutory right to have the goods brought into conformity (repair or replacement) and, under the conditions provided by law, to a price reduction or termination of the contract.

6.2 The statutory guarantee of conformity is two years from delivery of the goods. These terms do not restrict your statutory rights.

6.3 Any commercial guarantees voluntarily granted by us or by the manufacturer are in addition to the statutory guarantee and do not affect it.

 

7. Liability

7.1 We are liable to you in accordance with the statutory provisions. The clarifications below do not restrict your statutory rights.

7.2 In particular, we are liable without limitation for damage arising from injury to life, body or health, and for damage based on intent or gross negligence, whether on the part of us, our legal representatives or our vicarious agents.

7.3 Our liability under the mandatory provisions on product liability remains fully applicable.

7.4 No exclusion or limitation of our statutory liability towards you as a consumer is stipulated.

 

8. Governing law and final provisions

8.1 The law of the Grand Duchy of Luxembourg applies, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer with your habitual residence in another Member State of the European Union, you retain the protection afforded to you by the mandatory provisions of the law of your state of residence; this choice of law does not restrict that protection.

8.2 As a consumer, you may bring proceedings before the courts of your place of residence or those of the Seller's registered office, and may be sued only before the courts of your place of residence. Mandatory statutory places of jurisdiction remain unaffected.

8.3 We are neither obliged nor generally willing to participate in a dispute resolution procedure before a consumer arbitration body.

8.4 Should individual provisions of these terms be or become wholly or partially invalid, the validity of the remaining provisions remains unaffected. The statutory provisions replace any invalid provisions.
