1. Scope of Application

These General Terms and Conditions apply to all contracts concluded between Christine Kayser (hereinafter "Seller") and the customer (hereinafter "Customer") via the online shop www.colourand.life. Deviating conditions of the Customer shall not be recognized unless the Seller explicitly agrees to their validity in writing.

2. Conclusion of Contract

2.1. The presentation of products in the online shop constitutes a non-binding online catalog and not a legally binding offer.

2.2. By clicking the button "Checkout" or "Pay Now", the Customer places a binding order for the goods contained in the shopping cart.

2.3. The contract is concluded when the Seller accepts the order by sending a separate order confirmation via email or by dispatching the goods.

3. Prices and Payment

3.1. All prices are indicated in Euro (€). Since the Seller acts as a small business under Luxembourg law, VAT may be applicable depending on the registration status (currently indicated as gross prices).

3.2. Shipping costs are not included in the purchase price and are calculated based on weight and destination (see Section 4).

3.3. The following payment methods are available:

4. Shipping and Delivery

We ship worldwide via Post Luxembourg. The shipping costs are calculated as follows:

• Luxembourg: €10.00 – €12.00

• European Union (EU): €19.00 – €23.00

• Rest of the World (e.g., USA, UK, Switzerland): €42.00 – €58.00

Any potential customs duties, taxes, or fees for deliveries to countries outside the EU are the sole responsibility of the Customer.

5. Right of Withdrawal & Exceptions

IMPORTANT NOTICE: The right of withdrawal varies depending on the product type.

​

A. For Standard Products (e.g., "Intuitive Energy Art", Card Decks) Consumers have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire physical possession of the goods.

​

B. EXCLUSION of the Right of Withdrawal for Personalized Products According to Art. L. 222-9 (7) of the Luxembourg Consumer Code, the right of withdrawal does not apply to contracts for the supply of goods that are made to the consumer's specifications or are clearly personalized. Therefore, the sale of "Soul Portraits" (custom paintings based on the child’s name and age) is final and non-refundable.

6. Warranty (Legal Guarantee of Conformity)

Consumers residing in the EU are entitled to the statutory legal guarantee of conformity for goods (2 years) according to Luxembourgish consumer law. If the goods are defective, you may request repair or replacement, or if these are not possible, a price reduction or refund.

7. Liability

The Seller is liable for intent and gross negligence. Liability for slight negligence is excluded, provided that no essential contractual obligations (cardinal obligations) or damages resulting from injury to life, body, or health are affected.

8. Governing

Law These Terms and Conditions are governed by the laws of the Grand Duchy of Luxembourg.
